
Eagle Butte Man Sentenced on Assault Charge

United States Attorney Brendan V. Johnson announced that an Eagle Butte man charged with Assault with a Dangerous Weapon was sentenced on June 20, 2011, by United States District Judge Roberto A. Lange. Nelson Miles Red Bird, age 21, was sentenced to 40 months in custody, three years of supervised release, and a $100 special assessment to the Victim Assistance Fund. Red Bird was indicted by a federal grand jury on November 9, 2010. The charge stems from an incident that occurred on June 10, 2010, at Eagle Butte when Red Bird unlawfully assaulted two victims with a dangerous weapon, shod feet, with intent to do bodily harm to the victims. Red Bird pled guilty to the charge on March 15, 2011. This case was investigated by Cheyenne River Sioux Tribe Law Enforcement Services. Assistant United States Attorney Marie H. Ruettgers prosecuted the case. Red Bird was immediately turned over to the custody of the United States Marshal. |
